This brand new book addresses the traditional issues in a contemporary context. Other than the essential Supreme Court chestnuts, nearly all of the cases contained in this book were decided in 2001 or 2000. These cases have been significantly edited to make them more accessible to first-year students and to allow faculty members to assign several cases for one class meeting — making it possible to cover everything you want to cover in your civil procedure class. The authors, two of whom have been awarded a total of four Distinguished Teaching Awards at their host institution, also provide lots of problems in the Note materials for those professors who prefer to discuss the materials through the use of hypotheticals.
To make this book even more attractive, the authors have prepared an extensive Teacher's Manual with lengthy discussion of the cases, why those cases were chosen, and various pedagogic suggestions with respect to the materials. The authors intend to supplement the book with an online set of interactive diagnostic materials that first-year students will find particularly helpful. Two law professors from Tulane U. and one privately practicing lawyer present a casebook on civil procedure drafted with the first year student in mind. The case selections combine foundational Supreme Court cases and contemporary cases selected to address relevant issues. Textual comment proceeds the presentation of cases in chapters on adjudicative power, non-constitutional limitations on the exercise of adjudicative power, choosing and ascertaining applicable law, judicial remedies, pleading, discovery, disposition without trial, joinder of claims and parties, trials, appeals, the preclusive effect of adjudication on subsequent litigation, and alternatives to litigation.
